but his Portuguese and as it stands both England and Portugal are part of the EU so he wouldn't need one? Just like when Tim said the Croatian lad was a no go because he couldn't get a work permit Yet again both parties part of the EU so wouldn't need one?

Diogo doesn't need a work permit, he's an EU citizen. If he doesn't move, and I don't think he will, it will be because of other reasons.
